Term extension clause in construction contracts
Sharon Grados, founding partner of CLG, explores, based on international construction contract models (FIDIC, NEC), the SCL Delay and Disruption Protocol (2nd ed., 2017), the Peruvian legal system, specialized literature and various cases, the legal aspects (type of term, causes of delay, types of delay, mitigation deployed) and technical aspects (reference to contemporary schedules, ownership of slack, on-site records, method of delay analysis, among others) that an extension of time clause must consider and regulate, in order to fairly determine the granting of the remedy of the extension of time.
Concurrent fault and concurrent delay in construction contracts. Clarifications on the main aspects.
In this article, Sharon Grados, founding partner of CLG, analyzes the concept of concurrent fault regulated in the Peruvian Civil Code as a possible primary solution to the problems associated with concurrent delay in construction contracts. To do so, she clarifies the essential aspects of both concepts, with the aim of subsequently developing an analysis of their homologation and analogy.
